Nadeem Ahmed of A & Q filed a Review Petition before Honourable Supreme Court of Pakistan, with a plea that PCO that had been issued by General Musharraf be declared void ab initio (having no effect as on 3rd November 2007) and that the Honourable Court, after having declared PCO as illegal, had no basis or authority to extend the life of Ordinances (including NRO) that been promulgated by General Musharraf, beyond the maximum time period of 120 days, at the end of which they are to stand repealed as required by Article 89 of the Constitution, the very Article that gave President Musharraf the power to promulgated Ordinances. The Review Petition is expected to be fixed for hearing in October or November 2009.

On the petition of Nadeem Ahmed of A & Q, a fourteen member bench of the Honorable Supreme Court of Pakistan declared (a) all actions of General Musharraf of 3rd November 2007 as unconstitutional (b) induction of all persons in Supreme Court and High Courts since 2nd November 2007 without Constitutionally required ‘consultation’ of Chief Justice of Pakistan Justice Iftikhar Chaudhry, as illegal and void ab initio, and (c) it was declared that none of the judges who were purported to be deposed on 3rd November 2007 by General Musharraf, ceased to be judges, including Chief Justice Iftikhar Chaudhry, ceased to be judges for a single day.

Nadeem Ahmed of A & Q filed a petition before the Supreme Court of Pakistan seeking a declaration that post-2nd November 2007 induction of all ‘judges’ in the Supreme Court and in all the High Courts be declared as illegal as they inductions were done without meeting the Constitutional requirement of first ‘consulting’ the Chief Justice of Pakistan Justice Iftikhar Mohammad Chaudhry. He also prayed before the Supreme Court to declare all 3rd November 200 actions of General Musharraf, including promulgation of PCO, as illegal and also to declare that the Chief Justice of Pakistan Justice Iftikhar Mohammad Chaudhry remained Chief Justice of Pakistan from the first day that he assumed that office till today, without break of a single day.

A & Q, through Senior Advocate, Mr. Mohammad Akram Sheikh, filed appeals in the Honorable Supreme Court against the Honorable Lahore High Court’s judgment on Section 15 and finally obtained an order from the Honourable Supreme Court for suspending the operation of the judgment of Lahore High Court. The result is that till the hearing of the appeals and final judgment of Supreme Court on the validity of Section 15, all financial institutions shall be entitled to exercise the power to directly sell immoveable properties over which they may be holding mortgage.

A & Q held a seminar on the implications of Lahore High Court’s judgment on Section 15. On invitation of A & Q, Senior Advocate Supreme Court, Mr. Mohammad Akram Sheikh specially came from Islamabad to attend the seminar, which was attended by representatives of all commercial banks in Pakistan.

Lahore High Court delivered a judgment declaring Section 15 of Financial Institutions (Recovery of Finances) Ordinance 2001, as unconstitutional. The Section authorized mortgagee financial institutions, in case of default by their customer, to enforce their mortgages without intervention of courts.
